SECTION 25
Section 25 of Chapter 2, of the the constitution of the Republic of South Africa, 1996, which is the current constitution is what recently is revisited in our books of the constitution of South Africa. Wow! I always had the constitution of the Republic of South Africa at hand, and yes, I read it a number of times in order to understand the constitution of South Africa. But, frankly, I never read section 25, at least until now that the motion of "land expropriation" has been raised in the Parliament of South Africa and passed. Now, everyone in the country, I mean everyone, even your post apartheid born generation are shouting and chanting, "bring back our land!"
I'd like to take you for a visit through section 25 of the constitution of South Africa and let you be judge, and cogitate thoroughly on what needs to be amended in this section of the constitution.
it reads;
"Property
25 (1) No one may be deprived of property in terms of law of general application, and no law may permit arbitrary deprivation of property.
(2) Property may be expropriated only in terms of law of general application-
(a) for a public purpose or in the publicinterest; and
(b) subject to compensation, the amount of which and the time and manner of payment of which have either been agreed to by those affected or decided or approved by a court...."
